Why This Policy Exists
KANHA SUTRA products are marketed for mood, emotional well-being, connection, and intimacy. Because of that, information about the products you view, add to your cart, or purchase on our website may be treated under the laws of certain states as information about your health, even though we never ask you about your health and the information is ordinary shopping activity.
This Consumer Health Data Privacy Policy explains what we do with that information. It is required by, and written to comply with, the Washington My Health My Data Act (RCW 19.373), the Nevada Consumer Health Data Privacy Law (SB 370), and the consumer health data provisions of the Connecticut Data Privacy Act.
We apply this Policy to all of our customers, not only to residents of those states.
This Policy supplements our general Privacy Policy. Where the two conflict as to consumer health data, this Policy controls.

What We Mean by Consumer Health Data
State law defines consumer health data broadly. It covers information that identifies your past, present, or future physical or mental health status, and expressly includes information about reproductive or sexual health and bodily functions. It also covers information inferred or extrapolated from information that is not itself health information, including inferences drawn by algorithms.
In plain terms: the fact that you looked at, saved, or bought a KANHA SUTRA product could be used to infer something about your mood, your well-being, or your intimate life. That inference is what the law protects, whether or not we ever draw it.
Consumer Health Data We Collect
We may collect the following categories of consumer health data, all of which come from your own activity on our website or from information you choose to give us:

We do not collect, and we do not ask for:
- Medical records, diagnoses, conditions, or treatments
- Prescription or medication information
- Biometric or genetic data
- Precise geolocation data
- Information from health care providers, pharmacies, insurers, or health applications
- Information about reproductive or sexual health beyond what is inherent in the products you choose to buy
Why We Collect It and How We Use It
We use consumer health data only to:
- Fulfill your order, including processing payment, shipping your products, and handling returns and refunds
- Manage your account and subscription, including sending renewal reminders and processing cancellations
- Provide customer service and resolve problems
- Publish reviews you choose to submit
- Meet our legal obligations, including reporting serious adverse events to the U.S. Food and Drug Administration as required by 21 U.S.C. Section 379aa-1 and retaining records required by law
- Protect against fraud and secure our website
We do not use consumer health data to target advertising to you.
We do not use consumer health data to build audience segments, lookalike audiences, or retargeting lists.
We do not use consumer health data to train artificial intelligence or machine learning systems.
We do not permit third-party advertising technology to operate on our product detail pages, shopping cart, checkout, or order confirmation pages.
Consent
Where consumer health data is not strictly necessary to provide a product or service you have asked for, we ask for your consent before collecting it, and we tell you what we are collecting, why, who will receive it, and how to withdraw your consent.
You can withdraw your consent at any time by emailing privacy@kanhasutra.com or by using the preference center on our website. Withdrawing consent does not affect processing that has already taken place, and it does not affect data we are required to keep to complete your order or to meet a legal obligation.
We will never condition the sale of a product, or the quality of service you receive, on your agreeing to let us collect or share consumer health data that we do not need.
We Do Not Sell Consumer Health Data
We do not sell consumer health data, and we do not intend to.
Under Washington and Nevada law, a sale is defined broadly. It includes exchanges for anything of value, not only for money. Sharing data with an advertising platform in exchange for improved advertising performance can count as a sale even though no money changes hands.
Both states require a separate, signed authorization before any sale of consumer health data, containing the specific data being sold, the identity of the purchaser, the purpose, a statement that services cannot be conditioned on signing, revocation rights, and an expiration no later than one year from signature.
We do not request such authorizations, because we do not sell consumer health data. If that ever changes, we will obtain a valid signed authorization from you first, and you will never be required to give one.
Who We Share Consumer Health Data With
We share consumer health data only with service providers who need it to perform work for us, under contracts that prohibit them from using it for their own purposes.

We do not share consumer health data with affiliates.
We may also disclose consumer health data where required by law or legal process, to report a serious adverse event to the U.S. Food and Drug Administration, to protect against fraud or harm, or in connection with a merger or sale of assets, subject to the protections in this Policy.
Your Rights
You have the right to:
- Know whether we collect, share, or sell your consumer health data, and to receive a list of all third parties with whom we have shared it, including active contact information for each
- Access your consumer health data
- Withdraw your consent to our collection and sharing of it
- Delete your consumer health data

We will confirm receipt and respond within 45 calendar days. If we require additional time, we may extend our response once by a further 45 days, and we will tell you why.
Deletion
When you ask us to delete consumer health data, we will delete it from our records and will notify all of our service providers and affiliates to delete it from their records as well, and instruct them to honor your request. We will keep only what the law requires us to keep, such as serious adverse event records required under 21 U.S.C. Section 379aa-1 and transaction records required for tax purposes. We will tell you if any such exception applies to your request.
Appeals
If we decline your request, you may appeal by writing to privacy@kanhasutra.com with the subject line "Consumer Health Data Appeal." We will respond within 45 calendar days. If we deny your appeal, you may contact the Washington Attorney General at www.atg.wa.gov/file-complaint, the Nevada Attorney General, or the Attorney General of your own state.
Geofencing
We do not use geofencing. We do not and will not use any technology to establish a virtual boundary around a health care facility, pharmacy, clinic, or any other entity providing in-person health care services, for the purpose of identifying or tracking consumers, collecting consumer health data, or sending advertisements or messages related to health.
We instruct all of our marketing and media partners in writing not to use radius or location-based targeting around health care facilities.
How Long We Keep It
We keep consumer health data only as long as needed for the purposes described in this Policy, and then delete it, except where law requires longer retention:
- Serious adverse event records: 6 years, as required by 21 U.S.C. Section 379aa-1
- Transaction and order records: 7 years, for tax, regulatory, and audit compliance
- Any consumer health data authorization, if one is ever obtained: 6 years from signature, as required by Nevada law
How We Protect It
We apply the safeguards described in our general Privacy Policy, including encryption of data in transit and at rest, access controls and authentication requirements, and employee training on data handling. We additionally restrict internal access to consumer health data to personnel with a specific business need.
Changes to This Policy
If we make material changes to this Policy, we will post them here with a new "Last Updated" date and provide prominent notice on the Site before they take effect. We will not apply materially different practices to previously collected consumer health data without first obtaining your consent.
